Steps 4 - Investigation
An Investigator’s role is to gather relevant information and report to the Commission. Investigators do not take sides or act on anyone’s behalf and must keep the complaint confidential.
Investigators inform the respondent about the details of the complaint and discuss the matter with them. Depending on the circumstances, the respondent may have to:
- provide information to the investigator over the phone; or
- send a written response to the investigator addressing the complaint allegations.
- You may need to demonstrate that you have taken action to prevent discrimination and harassment.
The investigator may also visit the site of the alleged discrimination and/or interview witnesses. Based on the information gathered by the Investigator, the Commission may refer the matter to conciliation or decline the complaint .
