When does the law apply
All employees who are full-time, part-time, casual, temporary, contractors or paid on a commission basis have a right to be treated fairly in the workplace. Job applicants and probationary employees are also covered by the law. The only work that is not covered by the law is work carried out on a voluntary or unpaid basis.
Unlawful discrimination can occur in the workplace in relation to:
Recruitment: Who is offered the job, and its terms and conditions
During employment: The allocation of shifts, how employees are treated, access to opportunities for promotion, training, transfer, further development or any other benefits
Dismissal: Terminating an employment or contract, retrenchment, redundancy or not giving a contractor any further work
